Luigi Mangione prosecutors violate their health rights, says the defense

The defense lawyers of the alleged CEO shooter of Unitedhealthcare, Luigi Mangione, say that the prosecutors of the Office of the Manhattan district prosecutor are violating their health rights of health by accessing confidential medical information, according to a judicial presentation on Thursday looking for a hearing and sanctions.

“The district prosecutor has summoned to the health insurer of Mr. Mangione and, if believed in his account, partially reviewed the confidential, private and protected documents that the district prosecutor admits easily that they are protected by the Law on the Portability of Health Insurance and the Law of Responsibility.

Mangione declared himself innocent to kill the head of UnitedHare Brian Thompson in a street in the center of the city last December. Mangione was not covered by UnitedHealthcare.

Instead, prosecutors have said they wanted to send a message about corporate greed.

Their lawyers now seek access to the information of the prosecutors and the Mangione insurer, Aetna, arguing that the citation was inadequate.

“There is no doubt that people have violated Mangione Rights under hippa by possessing and reviewing the citation documents. However, the violation goes far beyond this. The violation also implies the intentional and knowledge of their medical-patient privilege,” said the defense.

The district prosecutor’s office said he will formally respond in judicial documents.

However, prosecutors said they requested limited information from Aetna and Aetna sent additional materials by error. The prosecutors said they eliminated the materials as soon as they realized them and called them to the attention of the defense and the court.

The error was aggravated by the defense lawyer who forwarded the prosecutors the same elements that prosecutors had already eliminated, said a source familiar with the citation.
